The Employee Free Choice Act ("Card Check"):

Share Your Thoughts With Congress

The Employee Free Choice Act, or the ?Card Check? Bill, may have a significant impact on HIDA members and their businesses. Currently, the proposed legislation has been approved in the House of Representatives but has not passed the Senate. Democratic leadership has signaled that passing the legislation will be a top priority in 2009. We urge HIDA members to review the EFCA and contact Congress with your thoughts and how it may affect your business.

Background: Under current labor law, the U.S. National Labor Relations Board certifies a labor union as an exclusive representation of employees if it is voted by either a majority signature drive (also known as a ?card check process?), or by secret ballot NLRB election. The Employee Free Choice Act (EFCA) would no longer permit employees to vote for a union by secret ballot. Under the legislation, a union would be formed when a majority of employees sign union cards (when the NLRB does not find illegal coercion). In addition, the EFCA;

  • Allows a union to begin bargaining with an employer 10 days after the card check process approves the union

  • Amends collective bargaining law

  • Increase some penalties for employers who violate union organizing laws
