Innocent Sellers Fairness Act Reintroduced in Congress
The Innocent Sellers Fairness Act (H.R. 2518) was reintroduced in the House of Representatives by Congressmen Dan Boren (D-OK) on May 20, 2009 after having garnered more than 60 cosponsors in the 110th Congress. If enacted, this legislation would protect sellers from predatory lawsuits by removing the liability from sellers if they merely supplied the product and had no part in its manufacturing. Current law imposes product liability on sellers without wrongdoing. Because medical-surgical products distributors are considered "sellers" by definition, they are subjected to unfair and predatory lawsuits.
HIDA supports this legislation to protect medical-surgical distributor companies from costly and frivolous lawsuits, while still protecting the rights of those with legitimate claims. We encourage our distributor members to reach out their respective Representative and urge them to protect our industry from predatory lawsuits by cosponsoring H.R. 2518.
